Divorce

For some reason, some people believe they can represent themselves properly when getting divorced. To quote the adage, a person who represents themselves has a fool for a lawyer. Without question, getting divorced is stressful, time consuming, and emotionally draining. It is the job of our Florida Divorce attorneys at Schantz and Schantz to help you deal with the stress of getting divorced. Once we are retained as your attorney it is our job to deal with the court system, your spouse’s attorney, forensic experts, etc. As a lay person, you may believe that you understand the Florida law as it relates to your divorce. Sure, you can read many articles on the internet explaining the law. What the internet fails to provide you with is the understanding of how to try the case in front of a real judge. The internet can’t teach you the rules of evidence and how to properly object. The internet can’t teach you how to preserve the appellate record just in case the judge makes an incorrect decision. The reason why attorneys go to law school is to learn how to make proper objections, how to cross examine your spouse, and to know the law. In fact, an attorney cannot practice law unless they have passed a bar exam. All to say, if you expect to put on your best case possible it is wise to have an attorney.

What We Do?

From the beginning of the divorce process we get to know your family situation and how that situation will impact the case. We will discuss if you have children, do you work or does your spouse work, how much does each spouse earn, what are the marital assets and all other issues related to your life. With that information we come up with a plan to help you obtain the best result possible. An attorneys job, like a doctor, is to give you objective and correct legal advice in accordance with the law. We will always tell you the truth as it relates to the law and your case. Once we have assembled a plan, we may want to settle your case before filing a divorce petition with the court. Also, if a pre-suit settlement appears impractical, we will immediately file divorce papers on your behalf. Nothing will take place without your knowledge and consent. As far as we are concerned it is a team approach how to resolve your case. In almost all cases the judge will order you to mediation. Mediation is the process where you can settle your case without the court’s intervention. In today’s world, many cases settle at mediation. That said, if mediation is unsuccessful our divorce attorneys will go to trial. We will fight vigorously for you based upon the law and facts of your case. After 38 years of law practice, Hale Schantz and Laura Schantz know how to try your case. We are real lawyers. We are NOT a law firm which dabbles in other types of law. The only law we practice is divorce law and family law.
